The Maharashtra Co-operative Societies (Amendment) Rules 2026 were notified on 18 June 2026 and published in the Gazette on 22 June 2026, the date they came into force. They insert Chapter XI-B — Rules 106C-1 to 106C-14 — written for housing societies alone, and new Forms Y-1 to Y-7. Here is what a committee needs to know. Money
- Interest on arrears: at most 12 % a year, simple (Rule 106C-12). The 2014 bye-laws allowed up to 21 % (BL 72). No interest during the payment period. If the general body has not fixed a rate, the draft 2026 bye-laws apply 12 % by default.
- Committee spending on repairs without general-body sanction (Rule 106C-13), one-time per year: ₹1 lakh (up to 25 members), ₹2 lakh (26–50), ₹3 lakh (51–100), ₹4 lakh (101–1,000), ₹5 lakh (above 1,000). The 2014 limits were ₹25,000 / ₹50,000 / ₹1 lakh (BL 156).
- Apportionment (Rule 106C-12): property tax on common areas, the major repair fund, insurance and lease rent move to carpet area; amenities and other funds are shared equally.
- Entrance fee ₹500 (Rule 106C-4), up from ₹100.
- Education & Training Fund: ₹10 per member per month (Rules 106C-7 and 106C-11).
- Borrowing up to ten times paid-up capital plus reserves and contributions (Rule 106C-10).
Meetings
- General-body meetings may be attended by video conference with recording and identification of participants (Rule 106C-13).
- Redevelopment special general meetings: 14 clear days’ notice, two-thirds of all members present in person, the Registrar’s representative, mandatory video recording, and approval by 51 % of the total membership.
Members
- New forms: Y-4 provisional member after a member’s death, Y-5 transfer by registered family arrangement, Y-5A associate member (Rules 106C-5, 106C-6).
- Forms J-1, J-2 and M-1 to M-19 are deleted.
Training
- Every member: one 3-hour session a year. Every committee member, office-bearer and employee: two (Rule 106C-7).
Recovery of dues
- Application for a recovery certificate in Form Y-6 with a ₹100 fee; the certificate in Form Y-7, executable as arrears of land revenue (Rule 106C-14; s.154B-29).
What waits for the final bye-laws
The draft Model Bye-laws 2026 carry the detail — registers, complaint clocks, retention, committee sizes. Objections closed on 27 August 2026 and the final text is awaited. Societies adopt them after notification.
